1. Scope and Provider

These Terms of Service ("Terms") govern your use of the Oratio AI platform ("Service"), accessible at oratio-ai.com, operated by:

By creating an account or using the Service, you agree to these Terms. If you do not agree, you may not use the Service.

2. Service Description

Oratio AI is a speech analysis platform that evaluates spoken communication across three dimensions: Message (content and structure), Voice (vocal delivery and energy), and Presence (visual body language, when video is provided). The Service generates AI-powered Perception Intelligence reports with actionable coaching recommendations.

The Service is currently in beta. Features, scoring models, and the user interface may change without prior notice. We make no guarantee of uninterrupted availability during the beta period.

3. Account

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must be at least 16 years old to use the Service.

You agree to provide accurate information during registration and to notify us promptly if you suspect unauthorised access to your account.

4. Plans, Credits, and Billing

4.1 Plans

Oratio offers a free tier and paid subscription plans (Speaker, Pro). Each plan includes a monthly allocation of analysis credits and access to specific features as described on our Pricing page.

4.2 Credits

Each analysis consumes credits based on the duration of the uploaded speech (1 credit per minute, rounded up). Credits reset monthly on your billing date. Unused credits do not roll over to the next billing period.

4.3 Billing

Paid subscriptions are billed monthly in advance via Stripe. Prices are displayed inclusive of applicable VAT where required by law.

• Upgrades: When you upgrade to a higher plan, the change takes effect immediately. You will be charged a prorated amount for the remainder of the current billing period.
• Downgrades: When you downgrade to a lower plan, the change takes effect at the end of the current billing period. You retain access to your current plan features until then.
• Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period. No partial refunds are provided for the remaining days of a billing period.

4.4 Price Changes

We may adjust pricing with at least 30 days' written notice (email). Continued use of a paid plan after a price change constitutes acceptance of the new price.

6. Your Content

You retain full ownership of all content you upload to Oratio, including audio files, video files, and any text content. By uploading content, you grant Oratio a limited, non-exclusive, non-transferable licence to process your content solely for the purpose of providing the Service (analysis and report generation).

Uploaded media files are automatically deleted from our servers immediately after analysis is complete. We store only the generated transcript and analysis results, which you can delete at any time by requesting account deletion.

You represent and warrant that you have the right to upload and process the content you submit, and that your content does not violate any third-party rights.

7. Acceptable Use

You agree not to use the Service to:

• Upload content that you do not have the right to process
• Upload content containing illegal material or content that violates the rights of others
• Attempt to reverse-engineer, decompile, or extract the underlying models or algorithms of the Service
• Circumvent usage limits, rate limits, or credit restrictions
• Use the Service for automated bulk processing without prior written consent
• Resell, sublicense, or redistribute access to the Service or its outputs without prior written consent

We reserve the right to suspend or terminate accounts that violate these terms.

8. Intellectual Property

The Service, including its design, code, models, analysis pipeline, branding, and documentation, is owned by Samim Faiz / Oratio AI and protected by applicable intellectual property laws.

Your analysis reports are generated for your personal or professional use. You may share, print, or use your reports freely. However, the underlying analysis engine, scoring models, and prompt architecture remain our intellectual property.

9. AI-Generated Content Disclaimer

Oratio reports are generated using artificial intelligence. While we strive for accuracy and usefulness, AI-generated analysis:

• May contain inaccuracies or subjective assessments
• Should not be considered a substitute for professional speech coaching, medical advice, or psychological assessment
• May vary between analyses of the same content due to the nature of large language models

You are responsible for how you use and act upon the information provided in your reports.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We are not liable for indirect, incidental, special, or consequential damages arising from your use of the Service.
• Our total aggregate liability for any claim related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

This limitation does not apply to liability for intent or gross negligence, injury to life, body, or health, or other liability that cannot be excluded under German law (§ 309 Nr. 7 BGB).

11. Termination

You may delete your account and terminate your use of the Service at any time by contacting us at hello@oratio-ai.com. Upon termination:

• Your active subscription (if any) will remain active until the end of the current billing period
• Your analysis data and reports will be permanently deleted
• Billing records will be retained as required by German tax law (see Privacy Policy, Section 7)

We may terminate or suspend your account if you materially breach these Terms, with reasonable notice where possible.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated at least 30 days in advance via email. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Germany. If you are a consumer within the EU, you additionally benefit from any mandatory consumer protection provisions of the law of your country of residence.

For consumers, the courts of your place of residence have jurisdiction. For all other users, the exclusive place of jurisdiction is Bonn, Germany.

The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
